1. Agreement to Terms

This website (the "Site") is owned and operated by Aether Trails ("we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement governing your access to our Site and your engagement with our travel planning services. By using the Site or booking a trip with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Our Role as a Travel Agency

Aether Trails acts as an agent for third-party travel suppliers, such as airlines, hotels, tour operators, and other service providers ("Suppliers"). We are dedicated to planning and arranging your travel, but we do not own or operate these Suppliers.

• Service Agreement: Your contract for the actual travel services is with the individual Supplier. Their terms and conditions will apply to your booking, and we strongly advise you to read them.
• Information Accuracy: We strive to provide accurate information regarding itineraries, pricing, and availability. However, this information is provided to us by the Suppliers and is subject to change without notice. We are not liable for any errors or omissions in the information provided by Suppliers.

3. Bookings, Payments, and Cancellations

Engaging our services for travel planning follows a structured process to ensure clarity and commitment.

• Booking Confirmation: A booking is considered confirmed only after we have received the required deposit and you have received a written confirmation from us.
• Payment Schedule: A deposit is required to secure your booking. The final balance is due on a specified date before departure. Failure to pay the final balance by the due date may result in the cancellation of your booking.
• Cancellation Policy: Cancellations must be submitted in writing. Cancellation fees will apply and vary depending on the notice given and the policies of our Suppliers. These will be clearly outlined in your booking agreement. We strongly recommend comprehensive travel insurance to cover potential cancellation costs.

4. Traveler Responsibilities

To ensure a smooth journey, you, the traveler, are responsible for the following:

• Travel Documents: You are responsible for ensuring that you have a valid passport, any necessary visas, and other required travel documents for all countries you will visit. Your passport must be valid for at least six months beyond your planned return date.
• Health and Safety: It is your responsibility to consult with a medical professional regarding required or recommended vaccinations and health precautions.
• Travel Insurance: We strongly recommend that all travelers purchase comprehensive travel insurance covering trip cancellation, medical emergencies, baggage loss, and other unforeseen events. Aether Trails is not liable for costs incurred due to a lack of adequate insurance.

5. Intellectual Property

All content on this Site, including the Aether Trails logo, text, graphics, and website design, is our property. The custom itineraries we create for you are our intellectual property and are provided for your personal use in connection with your trip. You are prohibited from reproducing or distributing our itineraries for commercial purposes without our prior written consent.

6. Limitation of Liability

As we act as an agent for Suppliers, we are not liable for any personal injury, property damage, loss, or other damages resulting from any act or omission of any Supplier. While we carefully vet our partners, we have no control over their operations. TO THE FULLEST EXTENT PERMITTED BY LAW, AETHER TRAILS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR SITE OR THE SERVICES PROVIDED BY THIRD-PARTY SUPPLIERS.

7. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice by updating the "Last Updated" date at the top of this page. Your continued use of the Site or our services after any such changes constitutes your acceptance of the new Terms.
